Terms of Use

1. These terms and who we are

Effective date: September 30, 2026

These Terms of Use (“Terms”) are an agreement between you and Alémar Advisors, Inc. (“Alémar,” “we,” “us” or “our”), a Delaware corporation with its principal business address at PO Box 4554, Park City, UT 84060, USA. They govern your use of https://alemaradvisors.com (the “Site”), including its contact and application forms.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Our Privacy Policy explains how we handle personal information and is part of these Terms.

These Terms cover the Site only. If we agree to provide advisory or other services to you or your company, those services will be governed by a separate written agreement (see section 5).

2. Using the Site

You must be at least 18 years old to use the Site’s forms or otherwise contact us through the Site. If you use the Site on behalf of a company or other organization, you confirm that you have authority to agree to these Terms for it.

You may use the Site for its intended purpose: learning about Alémar and getting in touch with us. You agree not to:

  • Use the Site in any way that breaks the law or infringes anyone’s rights
  • Send us anything that is false, misleading, defamatory, or that you do not have the right to share
  • Send spam, unsolicited commercial messages, or automated submissions through the Site’s forms
  • Use bots, scrapers or other automated tools to access the Site or collect information from it, except for search engines indexing public pages
  • Try to bypass security measures such as Cloudflare Turnstile, probe or test the Site for vulnerabilities without our written permission, or interfere with how the Site works
  • Introduce viruses, malware or other harmful code
  • Impersonate another person or organization, or misrepresent who you are

We may block or restrict access to the Site by anyone who violates these Terms.

3. Our content and trademarks

The Site and everything on it, including text, graphics, logos, page design and code, belong to Alémar or our licensors and are protected by copyright, trademark and other laws. The Alémar Advisors name and logo are our trademarks. Other names and logos on the Site belong to their owners.

You may view the Site and print or download pages for your own personal or internal business reference, as long as you keep any copyright and trademark notices intact. You may not copy, republish, sell, modify or create derivative works from the Site’s content, or use our name or logo, without our written permission. Linking to the Site’s public pages is fine, provided the link does not suggest we endorse you or misrepresent our relationship.

4. Information you send us

When you contact us through the Site or otherwise, we will handle your personal information as described in our Privacy Policy. Please do not send us confidential information through the Site’s forms. Until we have signed a written agreement with you, nothing you send us is confidential, and we cannot agree to keep it confidential.

If you send us ideas, suggestions or other feedback about our business or the Site, you agree that we may use it without any obligation to you. You confirm that anything you send us is yours to share and does not infringe anyone else’s rights.

Submitting a form does not create a client, advisory or other relationship between us. We will do our best to respond, but we are not obliged to reply to every message.

5. Not professional advice; services are covered separately

The Site is for general information about Alémar. Nothing on it is legal, financial, investment, tax or other professional advice, and you should not rely on it as such. Information on the Site may be out of date or contain errors, and we may change it at any time without notice.

Any advisory or other services we provide will be set out in a separate written agreement between you (or your company) and Alémar. That agreement, not these Terms, will govern those services, including fees, scope, confidentiality and each side’s responsibilities.

The Site is delivered and protected by service providers such as Cloudflare, and the Site’s forms use Cloudflare Turnstile. Your use of the Site is also subject to any terms those providers apply to visitors, such as security checks.

The Site may link to other websites and services that we do not control. We provide these links for convenience only. We do not endorse them and are not responsible for their content, accuracy, or how they handle your information. Your use of any third-party site is at your own risk and subject to that site’s terms and privacy policy.

7. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties or promises about the Site, express or implied, including that it will be accurate, complete, up to date, secure, uninterrupted, error-free or free of harmful components, or that it is fit for any particular purpose. We may change, suspend or remove any part of the Site at any time.

Some jurisdictions do not allow certain warranties to be excluded, so some of the above may not apply to you.

8. Limits on our liability, and your responsibility for your misuse

To the fullest extent the law allows, Alémar and its directors, officers, employees, advisors and service providers will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising out of or related to the Site or these Terms, however caused and whether or not we were told such damages were possible.

If, despite the above, we are found liable to you in connection with the Site, our total liability for all claims will not exceed US $100. This limit does not apply to liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by our negligence.

If your use of the Site in breach of these Terms or the law causes a claim against us, you agree to cover our reasonable costs and losses from that claim, including reasonable attorneys’ fees. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Governing law and disputes

These Terms and any dispute about the Site are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

If you have a concern, please contact us first at privacy@alemaradvisors.com; most issues can be resolved informally. Any dispute that cannot be resolved that way will be brought only in the state or federal courts located in Delaware, and you and we each agree to the personal jurisdiction of those courts. Nothing in this section prevents either of us from seeking an injunction or other urgent relief in any court with jurisdiction to protect intellectual property or confidential information.

10. Changes, ending access, and general terms

Changes to these Terms. We may update these Terms from time to time. When we do, we will post the new version on the Site and update the effective date at the top. Your continued use of the Site after a change means you accept the updated Terms.

Ending access. We may suspend or end your access to the Site at any time if we believe you have violated these Terms or the law. Sections 3, 4, 5, 7, 8, 9 and 10 continue to apply after your access ends.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Alémar about the Site. They do not replace any separate written agreement for services.

Severability. If any part of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable part will be applied to the fullest extent the law allows.

No waiver. If we do not enforce a part of these Terms, that does not mean we have given up the right to enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours as part of a merger, sale or reorganization of our business.
